The Small Business Administration (SBA) recently issued a series of Frequently Asked Questions (FAQs) on the Paycheck Protection Program (PPP) which was passed as part of the Coronavirus Aid, Relief, and Economic Security Act (CARES Act).
FAQs Address Issues of Concern for Borrowers and Lenders
According to the document:
Borrowers and lenders may rely on the guidance provided in this document as SBA’s interpretation of the CARES Act and of the Paycheck Protection Program Interim Final Rule (“PPP Interim Final Rule”). The U.S. government will not challenge lender PPP actions that conform to this guidance, and to the PPP Interim Final Rule and any subsequent rulemaking in effect at the time.

As you may be aware, on March 23, 2020, Massachusetts Governor Charlie Baker issued an emergency order requiring all businesses and organizations in the Commonwealth of Massachusetts that do not provide COVID-19 (coronavirus) essential services to close their physical workplaces and facilities to workers, customers and the public. Payroll services have been deemed essential by both the Cybersecurity & Infrastructure Security Agency (CISA) of the US Department of Homeland Security (DHS) and the Commonwealth of Massachusetts and so Vision Payroll shall remain open during the time covered by this emergency order.
First Responders and Others Will Receive Paychecks
This allows Vision Payroll to continue to ensure that timely paychecks are received by first responders, healthcare professionals, caregivers and many others on the front line of defense against COVID-19 and the virus that causes it. In addition, we can continue to ensure timely payment for those in supporting roles such as grocery stores, transportation, financial services, and many others.
Vision Payroll Working to Minimize Risk
Vision Payroll has taken important steps to minimize the risk of spread of COVID-19, including shifting many employees to remote worksites, closing our office to all but a few employees and essential support service personnel, and maintaining proper social distance between employees whose work necessitates their physical presence in the office.
Consult Your Attorney for Answers in This Rapidly Changing Area
Please understand that we are in an unprecedented time of emergency orders and rapidly changing laws and regulations. While we can often point you in the right direction to find answers to your questions, any questions about legal requirements should be directed to an attorney who specializes in labor law or taxation. We have worked with several attorneys in these areas and will be happy to provide references should you request them. Remember though, some answers are just not available at this time, as we wait for the government to provide needed clarification.

Vision Payroll reminds employers that under the Massachusetts Employment and Training Law, MGL Chapter 151A, employers must provide a copy of Form 0590-A as soon as practicable, but no more than 30 days, from the last day an employee performed compensable work. Employers must provide this pamphlet to each employee who is separated from work, permanently or temporarily.

Following recommendations of the CDC and other government agencies, and consistent with industry and community-wide standards, we are closing the office to visitors effective March 22. This will minimize the risk of passing the virus among our employees, our customers, and our vendors.
Determine Delivery Method for Payrolls Normally Picked Up at Office
If you normally pick up payroll, please let us know if you would like electronic delivery of reports or delivery by UPS or USPS. Also, verify the address where you would like your payroll package delivered. As a reminder, you can view reports, including check amounts, 24 hours a day, 7 days a week using our online services.
Submit Early to Help Minimize Delivery Delays
Further, due to the inefficiencies inherent with helping to protect our employees by having employees whose jobs do not require their physical presence at the office working remotely, we suggest you submit payroll as early as possible to offset processing and delivery days. We recommend payrolls be submitted by Monday, whenever possible.

Additionally, there is a very strong possibility that travel may become restricted at some point or that all but a very few businesses will be required to close to the public. As a payroll company, we are generally exempt from such restrictions, but you may be limited in your ability to travel to pick up payroll.

Wednesday, January 1, 2020 will be New Year’s Day, a federal holiday. The offices of Vision Payroll will close New Year’s Eve, Tuesday December 31 at 3 pm EST and re-open Thursday January 2. Most banks will also be closed in observance of the holiday. Payroll changes and hours must be submitted before the processing deadlines as listed below.

Payroll Dates May Be Affected by New Year’s Day
Payrolls dated January 1 will be paid December 31 unless a previous change in schedule has been submitted. Payrolls submitted after these processing deadlines will be pushed back until the next available processing day. No changes are required for payrolls dated January 6.
Bank Withdrawal Dates Will Change for Some Payrolls
For payrolls dated December 31, including those normally paid on Wednesdays, ACH withdrawals from clients’ accounts will occur on Monday, December 30. For payrolls dated January 2, ACH withdrawals from clients’ accounts will occur on Tuesday, December 31. This is necessary to ensure timely crediting of employees’ accounts on the proper day.
UPS Will Limit Deliveries and Pickups
Due to heavy USPS and UPS delivery requirements as well as limited bank hours and staffing, we strongly recommend submitting payrolls during this time as early as practicable. Ground packages received by UPS on December 31 do not ship from UPS until January 2 so we do not recommend submitting on that date any payrolls dated before January 3.
Birthday of Martin Luther King, Jr. Is Next Federal Holiday
The next federal holiday will be Monday, January 20, 2020, Birthday of Martin Luther King, Jr. Contact Vision Payroll as soon as possible to make changes to or for questions on your processing schedule.
