Guidance was provided to employers by the <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\"><span style=\"color: #0000ff;\">US Department of Labor (DOL)<\/span><\/a> in <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2013\/09\/tr13-02.pdf\" target=\"_blank\"><span style=\"color: #0000ff;\">Technical Release No. 2013-02, <em>Guidance on the Notice to Employees of Coverage Options under Fair Labor Standards Act \u00a718B and Updated Model Election Notice under the Consolidated Omnibus Budget Reconciliation Act of 1985<\/em><\/span><\/a>.<\/p>\n<p><strong>Employers Required to Provide the Notice<\/strong><\/p>\n<p>Employers subject to the Fair Labor Standards Act (FLSA) are subject to the notice requirements. The <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">DOL<\/a> offers an <a href=\"http:\/\/www.dol.gov\/elaws\/esa\/flsa\/scope\/screen24.asp\" target=\"_blank\">online tool<\/a> to help employers determine if they are subject to the FLSA. One of the criteria is that employees who are engaged in, or produce goods for, interstate commerce are subject to the FLSA.<\/p>\n<p><strong>Examples of Covered Employees Who Are Engaged in Interstate Commerce<\/strong><\/p>\n<p>The <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">DOL<\/a> <a href=\"http:\/\/www.dol.gov\/elaws\/esa\/flsa\/scope\/screen24.asp\" target=\"_blank\">online tool<\/a> provides the following examples of employees who are engaged in interstate commerce:<\/p>\n<ul>\n<li><span style=\"color: #000000;\">An employee such as an office or clerical worker who uses a telephone, facsimile machine, the US mail, or a computer E-mail system to communicate with persons in another state. <\/span><\/li>\n<li><span style=\"color: #000000;\">An employee who drives or flies to another state. <\/span><\/li>\n<li><span style=\"color: #000000;\">An employee who unloads goods which came from an out of state supplier. <\/span><\/li>\n<li><span style=\"color: #000000;\">An employee such as a cashier or waitress who uses an electronic device which authorizes a credit card purchase. <\/span><\/li>\n<\/ul>\n<p><strong>Examples of Covered Employees Performing Support Work<\/strong><\/p>\n<p>The <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">DOL<\/a> <a href=\"http:\/\/www.dol.gov\/elaws\/esa\/flsa\/scope\/screen24.asp\" target=\"_blank\">online tool<\/a> provides the following examples of e<span style=\"color: #000000;\">mployees who perform support functions for\u00a0instrumentalities of interstate commerce that are so closely related to interstate commerce that they are also considered to be engaged in interstate commerce:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">A security worker at an airport. <\/span><\/li>\n<li><span style=\"color: #000000;\">A custodian who works for a janitorial contractor which cleans a bus terminal. <\/span><\/li>\n<li><span style=\"color: #000000;\">A laborer or mechanic who performs maintenance or repair work on machines used in the production of goods for interstate commerce or improvements to a city street. <\/span><\/li>\n<\/ul>\n<p><strong>Examples Are Not an Exclusive Listing<\/strong><\/p>\n<p>The above examples are not intended to be an exclusive listing.
