Guidance was provided to employers by the <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">US Department of Labor (DOL)<\/a> in <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2013\/09\/tr13-02.pdf\" target=\"_blank\">Technical Release No. 2013-02, <em>Guidance on the Notice to Employees of Coverage Options under Fair Labor Standards Act \u00a718B and Updated Model Election Notice under the Consolidated Omnibus Budget Reconciliation Act of 1985<\/em><\/a>.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Employers Required to Provide the Notice<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Employers subject to the Fair Labor Standards Act (FLSA) are subject to the notice requirements. <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">US DOL<\/a> <a href=\"http:\/\/www.dol.gov\/whd\/\" target=\"_blank\">Wage and Hour Division (WHD)<\/a> <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2013\/09\/Fact-Sheet-14.pdf\" target=\"_blank\">Fact Sheet #14<\/a> provides information on who is covered by the FLSA.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">All Employees Must Receive Notice<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">All employees, including part-time employees and employees not eligible to participate, must receive a notice.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Two Model Notices Are Available<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">The DOL has prepared and made available two model notices, <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2013\/09\/FLSAwithplans.pdf\" target=\"_blank\">one for employers that offer health insurance<\/a> to their employees and <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2013\/09\/FLSAwithoutplans.pdf\" target=\"_blank\">one for employers that do not offer health insurance<\/a> to their employees. An employer would only provide one type of notice to all employees, regardless of whether the individual employee is eligible for health insurance.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Deadline is October 1, 2013<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\">Employers must provide the notice on or before October 1, 2013 to all current employees hired before October 1, 2013. Employees hired after September 30, 2013 must be provided the notice at the time of hiring.
