You don\u2019t need to withhold tax for New York State, New York City, or Yonkers income tax purposes on the value of certain benefits (<em>e.g.<\/em>, domestic partner health benefit), even though it\u2019s subject to federal withholding. This applies if the employee\u2019s federal taxable wages subject to withholding include the value of the benefits, and the value of these benefits wouldn\u2019t be included in taxable wages if provided to a different-sex married spouse.<\/li>\n<li>When reporting the annual wage totals on <a href=\"http:\/\/www.tax.ny.gov\/bus\/ads\/efile_addnys45.htm\" target=\"_blank\">Form NYS-45, <em>Quarterly Combined Withholding, Wage Reporting, and Unemployment Insurance Return<\/em><\/a>, Part C, column d; report the federal wages minus any amount of benefits discussed above that you don\u2019t withhold on for New York purposes (plus any amount of any taxable 414(h) retirement contributions and any IRC 125 amounts from a New York City flexible benefits program for governmental employees).<\/li>\n<li>Continue to use the rules described in the <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2011\/08\/nys50.pdf\" target=\"_blank\">NYS-50, <em>Employer\u2019s Guide to Unemployment Insurance, Wage Reporting, and Withholding Tax<\/em><\/a> for reporting State and local wages on federal <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2011\/07\/fw2-2011.pdf\" target=\"_blank\">Form W-2, <em>Wage and Tax Statement<\/em><\/a>.<\/li>\n<\/ul>\n<p><strong>Same-Sex Employees Should Consider Filing a New Form IT-2104<\/strong><\/p>\n<p>Same-sex employees should consider\u00a0filing a new <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2011\/08\/it2104_fill_in.pdf\" target=\"_blank\">Form IT-2104, <em>Employee\u2019s Withholding Allowance Certificate<\/em><\/a>, if they will be changing their filing status on their 2011 New York\u00a0income tax return.
