{"id":563,"date":"2009-03-28T22:49:25","date_gmt":"2009-03-29T02:49:25","guid":{"rendered":"https:\/\/old.visionpayroll.com\/kb\/?p=563"},"modified":"2009-05-25T14:20:42","modified_gmt":"2009-05-25T18:20:42","slug":"department-of-labor-extends-effective-date-of-rules-on-401k-and-ira-investment-advice","status":"publish","type":"post","link":"https:\/\/old.visionpayroll.com\/kb\/2009\/03\/department-of-labor-extends-effective-date-of-rules-on-401k-and-ira-investment-advice\/","title":{"rendered":"Department of Labor Extends Effective Date of Rules on 401(k) and IRA Investment Advice"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\">On January 21, 2009, the <a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">US Department of Labor (DOL)<\/a> published at 74 FR 3822 \u201cfinal rules under the Employee Retirement Income Security Act, and parallel provisions in the Internal Revenue Code of 1986, relating to the provision of investment advice by a fiduciary adviser to participants and beneficiaries in participant-directed individual account plans, such as <a href=\"http:\/\/www4.law.cornell.edu\/uscode\/26\/usc_sec_26_00000401----000-.html\" target=\"_blank\">401(k)<\/a> plans, and beneficiaries of individual retirement accounts (and certain similar plans). These rules [affected] sponsors, fiduciaries, participants and beneficiaries of participant-directed individual account plans, as well as providers of investment and investment advice related services to such plans.\u201d<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt; mso-layout-grid-align: none;\"><span style=\"font-size: 10pt; font-family: Verdana;\">On January 20, 2009 Rahm Emanuel, Assistant to the President and Chief of Staff, had \u201c<\/span><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: Melior;\">directed Agency Heads to consider extending for 60 days the effective date of regulations that have been published in the <\/span><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: Melior-Bold; mso-bidi-font-weight: bold;\"><strong>Federal Register <\/strong><\/span><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: Melior;\">but not yet taken effect.\u201d Pursuant to that memo, the [<a href=\"http:\/\/www.dol.gov\/\" target=\"_blank\">DOL<\/a>] <a href=\"http:\/\/www.dol.gov\/opa\/media\/press\/ebsa\/EBSA20090307.htm\" target=\"_blank\">announced recently<\/a> that it was delaying the effective date of those rules from March 23, 2009 to May 22, 2009.
