These prevailing wage schedules contain hourly wage rates that workers must receive when working on a public project.<\/p>\n<p><strong>DOS Recently Released <\/strong><strong>PW-2010-11-07.29.10 on Prevailing Wages<\/strong><strong><\/strong><\/p>\n<p>The <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Occupational+Safety&amp;sid=Elwd\" target=\"_blank\">DOS<\/a> regularly issues <a href=\"http:\/\/www.mass.gov\/?pageID=elwdsubtopic&amp;L=5&amp;L0=Home&amp;L1=Workers+and+Unions&amp;L2=Wage+and+Employment+Related+Programs&amp;L3=Prevailing+Wage+Program&amp;L4=Prevailing+Wage+Opinion+Letters&amp;sid=Elwd\" target=\"_blank\">Prevailing Wage Opinion Letters<\/a> and recently released <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2010\/10\/EOLWD-PW-2010-11-07.29.10.pdf\" target=\"_blank\">PW-2010-11-07.29.10<\/a>. This letter confirms that the University of Massachusetts is one of \u201cthe several departments of the government of the commonwealth\u201d and therefore subject to MGL, c. 5, \u00a71. As such, the print shop at the University of Massachusetts \u2013 Amherst \u201cmust require its printing contractors\u2026to pay prevailing wage rates to their employees.\u201d<\/p>\n<p><strong><div class=\"img alignright size-full wp-image-3536\" style=\"width:184px;\">\r\n\t<a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2010\/07\/MA-EOLWD-Secretary-Joanne-F.-Goldstein.jpg\"><img src=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2010\/07\/MA-EOLWD-Secretary-Joanne-F.-Goldstein.jpg\" alt=\"\" width=\"184\" height=\"250\" \/><\/a>\r\n\t<div>MA EOLWD Secretary Joanne F. Goldstein<\/div>\r\n<\/div>MGL, c. 5, \u00a71 Mandates Prevailing Wages<\/strong><\/p>\n<p>According to the <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Occupational+Safety&amp;sid=Elwd\" target=\"_blank\">DOS<\/a>, the relevant part of MGL, c. 5, \u00a71 provides as follows:<\/p>\n<p style=\"padding-left: 30px;\">The commissioner of administration, <em>or any other awarding official<\/em>, in the advertising for bids or the placing of orders for the execution of printing, composition, proof reading, presswork, all processes used in the making of printing plates, paper ruling and binding, or for the supplying of office stationery and blank books without printed headings, <em>for the several departments of the government of the commonwealth other than the legislative department\u2026<\/em> Contracts or orders shall be given to such establishments only as pay the prevailing rate of wages, based on wage rates and working hours that have been established by collective bargaining agreement or understanding between organized labor and employers; provided, that nothing herein contained shall prevent said commission, or any other awarding official, from placing contracts or orders with existing state institutions or departments which furnish printing or other work of the kind and character above mentioned&#8230;<\/p>\n<p><strong>The University of Massachusetts is One of the Several Departments of the Government of the Commonwealth<\/strong><\/p>\n<p>The <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Occupational+Safety&amp;sid=Elwd\" target=\"_blank\">DOS<\/a> concludes that the preponderance of the authority indicates that the University of Massachusetts is one of \u201cthe several departments of the government of the commonwealth\u201d. Among other factors are the following<\/p>\n<ul>\n<li>The University of Massachusetts \u201cis subject to the statutory provisions governing capital facility projects under the division of capital asset management.\u201d<\/li>\n<li>The University of Massachusetts is subject \u201cto the competitive bidding laws.\u201d<\/li>\n<li>The University of Massachusetts \u201cdoes not dispute that it is subject to the prevailing wage law for construction of public works projects.\u201d<\/li>\n<li>\u201c<a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Occupational+Safety&amp;sid=Elwd\" target=\"_blank\">DOS<\/a>\u2019s records reflect that the University\u2019s Boston campus regularly requests <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Occupational+Safety&amp;sid=Elwd\" target=\"_blank\">DOS<\/a> to provide prevailing wage rates for its printing and binding contracts.\u201d<\/li>\n<\/ul>\n<p><strong>The DOS <\/strong><strong>Concludes that the University Is Subject to the Prevailing Wage Law<\/strong><\/p>\n<p>\u201cBecause the University is subject to the prevailing wage law for printing, contractors which provide printing services to the University are required to pay the prevailing wage rate set by the <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Occupational+Safety&amp;sid=Elwd\" target=\"_blank\">DOS<\/a> for such contracts.\u201d<\/p>\n<p><strong>Vision Payroll Assists Employers Preparing Certified Weekly Payroll Reports<\/strong><\/p>\n<p><a href=\"mailto:info@visionpayroll.com\" target=\"_blank\">Vision Payroll<\/a> is ready to assist employers in gathering information for certified weekly payroll reports. <a href=\"mailto:info@visionpayroll.com\" target=\"_blank\">Vision Payroll<\/a> can also prepare the certified weekly payroll reports for submission to the proper authorities.
