Quon\" width=\"300\" height=\"199\" \/><\/a>\r\n\t<div>Employee Texting and Workplace Privacy<\/div>\r\n<\/div>The issue of an employee\u2019s privacy rights and an employer\u2019s workplace monitoring of electronic communications have gained the attention of the US Supreme Court and recently led to a key decision that favors employers.<\/p>\n<p>In <a href=\"https:\/\/old.visionpayroll.com\/kb\/wp-content\/uploads\/2010\/08\/City-of-Ontario-v.-Quon.pdf\" target=\"_blank\"><em>City of Ontario, et al.\u00a0v. Quon, et al.<\/em>, 560 US ___ (2010)<\/a>, an employee (Quon) and others sued their employer (City of Ontario) arguing that the City of Ontario \u201cviolated their Fourth Amendment rights and the federal Stored Communications Act (SCA) by obtaining and reviewing the transcript of Quon\u2019s pager messages.\u201d The US Supreme Court ruled that since \u201cthe search of Quon\u2019s text messages was reasonable, [the City of Ontario] did not violate [Quon\u2019s and his co-workers\u2019] Fourth Amendment rights, and the Ninth Circuit erred by concluding otherwise.\u201d<\/p>\n<p>Employers may wonder about their rights and responsibilities when monitoring an employee\u2019s electronic communications.
