As a result, it was alleged that FedEx Ground underpaid payroll taxes, workers\u2019 compensation and unemployment assistance.<\/p>\n<p>\u201cWe have made enforcement against employer misclassification a priority because employers who misclassify workers are gaining an unfair advantage over their competitors and unfairly depriving the Commonwealth of tax and other revenues,\u201d <a href=\"http:\/\/www.mass.gov\/?pageID=cagohomepage&amp;L=1&amp;L0=Home&amp;sid=Cago\" target=\"_blank\">AG Coakley<\/a> said. \u201cWith today\u2019s agreement, we have recovered $3 million owed to taxpayers and taken a step to level the playing field for businesses. I want to thank <a href=\"http:\/\/www.mass.gov\/?pageID=gov3homepage&amp;L=1&amp;L0=Home&amp;sid=Agov3\" target=\"_blank\">Governor Patrick<\/a> and his <a href=\"http:\/\/www.mass.gov\/?pageID=elwdhomepage&amp;L=1&amp;L0=Home&amp;sid=Elwd\" target=\"_blank\">Executive Office of Labor and Workforce Development<\/a> and the <a href=\"http:\/\/www.mass.gov\/?pageID=dorhomepage&amp;L=1&amp;L0=Home&amp;sid=Ador\" target=\"_blank\">Department of Revenue<\/a> for assisting in the investigation and resolution of this matter.\u201d<\/p>\n<p>In 2007, the <a href=\"http:\/\/www.mass.gov\/?pageID=cagohomepage&amp;L=1&amp;L0=Home&amp;sid=Cago\" target=\"_blank\">Attorney General\u2019s Office<\/a> cited FedEx Ground for violation of the Independent Contractor Law, by misclassifying its drivers, failing to provide a proper paystub, failing to provide workers\u2019 compensation, not paying overtime to certain drivers, and neglecting to deduct and withhold state income taxes. FedEx Ground appealed the matter to the <a href=\"http:\/\/www.mass.gov\/?pageID=afagencylanding&amp;L=4&amp;L0=Home&amp;L1=Hearings+%26+Appeals&amp;L2=Oversight+Agencies&amp;L3=Division+of+Administrative+Law+Appeals&amp;sid=Eoaf\" target=\"_blank\">Division of Administrative Law Appeals (DALA)<\/a>. The <a href=\"http:\/\/www.mass.gov\/?pageID=cagohomepage&amp;L=1&amp;L0=Home&amp;sid=Cago\" target=\"_blank\">Attorney General\u2019s Office<\/a> citations against Fed Ex Ground included penalties of more than $190,000.<\/p>\n<p>While FedEx Ground\u2019s appeal was pending before <a href=\"http:\/\/www.mass.gov\/?pageID=afagencylanding&amp;L=4&amp;L0=Home&amp;L1=Hearings+%26+Appeals&amp;L2=Oversight+Agencies&amp;L3=Division+of+Administrative+Law+Appeals&amp;sid=Eoaf\" target=\"_blank\">DALA<\/a>, the <a href=\"http:\/\/www.mass.gov\/?pageID=cagohomepage&amp;L=1&amp;L0=Home&amp;sid=Cago\" target=\"_blank\">Attorney General\u2019s Office<\/a> coordinated further investigation with the <a href=\"http:\/\/www.mass.gov\/?pageID=elwdhomepage&amp;L=1&amp;L0=Home&amp;sid=Elwd\" target=\"_blank\">Executive Office of Labor and Workforce Development<\/a> and the <a href=\"http:\/\/www.mass.gov\/?pageID=dorhomepage&amp;L=1&amp;L0=Home&amp;sid=Ador\" target=\"_blank\">Department of Revenue<\/a> into FedEx Ground\u2019s business practices. The joint investigation revealed that FedEx Ground\u2019s misclassification of employees had resulted in significant underpayments to the <a href=\"http:\/\/www.mass.gov\/?pageID=dorhomepage&amp;L=1&amp;L0=Home&amp;sid=Ador\" target=\"_blank\">Department of Revenue<\/a>, <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Department+of+Industrial+Accidents&amp;sid=Elwd\" target=\"_blank\">Division of Industrial Accidents<\/a> and <a href=\"http:\/\/www.mass.gov\/?pageID=elwdagencylanding&amp;L=4&amp;L0=Home&amp;L1=Government&amp;L2=Departments+and+Divisions+(EOLWD)&amp;L3=Division+of+Unemployment+Assistance&amp;sid=Elwd\" target=\"_blank\">Department of Unemployment Assistance<\/a>.<\/p>\n<p>The settlement amount includes these significant underpayments. The settlement also provides for a payment for the 13 drivers named in the <a href=\"http:\/\/www.mass.gov\/?pageID=cagohomepage&amp;L=1&amp;L0=Home&amp;sid=Cago\" target=\"_blank\">Attorney General\u2019s<\/a> citation. FedEx Ground drivers in Massachusetts have brought their own lawsuit against FedEx Ground that remains pending and is not affected by this settlement. FedEx Ground denies liability in the settlement.<\/p>\n<p>Massachusetts uses a <a href=\"https:\/\/old.visionpayroll.com\/kb\/2008\/08\/question-of-the-week-does-massachusetts-have-laws-regarding-employees-and-independent-contractors\/\" target=\"_blank\">three-factor test<\/a> to determine if service providers should be considered employees or independent contractors.
