{"id":268,"date":"2009-01-13T21:17:11","date_gmt":"2009-01-14T02:17:11","guid":{"rendered":"https:\/\/old.visionpayroll.com\/kb\/?p=268"},"modified":"2009-01-13T21:17:11","modified_gmt":"2009-01-14T02:17:11","slug":"form-i-9-revised-by-uscis","status":"publish","type":"post","link":"https:\/\/old.visionpayroll.com\/kb\/2009\/01\/form-i-9-revised-by-uscis\/","title":{"rendered":"Form I-9 Revised by USCIS"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\">The <a href=\"http:\/\/www.uscis.gov\/portal\/site\/uscis\" target=\"_blank\">United States Citizenship and Immigration Services (USCIS)<\/a> has submitted an <a href=\"http:\/\/edocket.access.gpo.gov\/2008\/E8-29874.htm\" target=\"_blank\">interim final rule<\/a> to change <a href=\"http:\/\/www.uscis.gov\/files\/form\/I-9.pdf\" target=\"_blank\">Form I-9, Employment Eligibility Verification<\/a>. The rule will become effective February 2, 2009.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\">There are three categories of documents that employers may use for employment verification: List A that establishes identity and employment authorization, List B that establishes identity, and List C that establishes employment authorization. The rule eliminates the ability of employers to accept expired documents, although the <a href=\"http:\/\/www.uscis.gov\/portal\/site\/uscis\" target=\"_blank\">USCIS<\/a> has invited comments on and will consider allowing employers to accept List B documents \u201cthat have expired within the last ninety days (or other limited time period).\u201d<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\">The interim final rule also adds passports of the Federated States of Micronesia (FSM) and the Republic of the Marshall Islands (RMI) to acceptable List A documents. Citizens of both the FSM and the RMI may, but are not required to, obtain Form I-766, Employment Authorization Document.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Further, the interim final rule eliminates Forms I-688, I-688A, and I-688B from acceptable List A documents since these documents are no longer issued and all issued forms are now expired.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 6pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\"><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">There are numerous other miscellaneous changes, including changes to correct references to terminology that has changed.
