This is the one of a continuing series that discusses FLSA exemptions. The administrative exemption allows employees who qualify as \u201cadministrative employees\u201d to be exempted from both minimum wage and overtime requirements. Earlier posts discussed the definition of an administrative employee. The following are examples of specific jobs that generally either qualify or don\u2019t qualify the employee under the administrative exemption:<\/span><\/p>\n<ul style=\"margin-top: 0in;\" type=\"disc\">\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Insurance claims adjusters qualify whether they work for an insurance or other type company.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Financial services employees who analyze information, advise customers, market, service or promote the products qualify, but not those whose primary duty is selling.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Employees who lead a team of employees \u201cassigned to complete major projects for the employer\u201d, even those without direct supervisory authority should qualify.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Executive assistant or administrative assistant to a business owner or senior executive will qualify if the assistant has been delegated authority over significant matters.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Human resources mangers who \u201cformulate, interpret or implement employment policies\u201d do qualify. Personnel clerks who screen applicants for minimum acceptable standards as set by others generally do not qualify.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Management consultants who propose changes in a business\u2019s operation qualify.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Purchasing agents with authority to make significant purchases qualify even if the agents need consultation for unusually large commitments.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Inspectors \u201calong standardized lines involving well-established techniques and procedures\u201d and those doing other ordinary inspection work do not qualify.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Examiners or graders do not qualify, even if the employee has progressed to a point that reference to written standards is unnecessary because of acquired knowledge.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Comparison shoppers who report prices to a retail stores buyer do not qualify, but the buyer who evaluates the information to set the prices does qualify.<\/span><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0in 0in 6pt; mso-list: l0 level1 lfo1; tab-stops: list .5in;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Inspectors and investigators in the public sector, including those involved in \u201cfire prevention or safety, building or construction, health or sanitation, environmental or soils specialists\u201d among others do not qualify.<\/span><\/li>\n<\/ul>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt;\"><span style=\"font-size: 10pt; font-family: Verdana;\">Note that merely giving someone a title does not qualify the employee as exempt unless the duties and responsibilities that the job encumbers are <span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;\">also designated. <\/span>State laws may provide rules that are more beneficial to the employee and must be followed.
