{"id":161,"date":"2008-10-01T10:28:00","date_gmt":"2008-10-01T14:28:00","guid":{"rendered":"https:\/\/old.visionpayroll.com\/kb\/?p=161"},"modified":"2009-03-17T13:16:54","modified_gmt":"2009-03-17T17:16:54","slug":"tip-of-the-week-start-planning-now-to-comply-with-identity-theft-regulation","status":"publish","type":"post","link":"https:\/\/old.visionpayroll.com\/kb\/2008\/10\/tip-of-the-week-start-planning-now-to-comply-with-identity-theft-regulation\/","title":{"rendered":"Tip of the Week: Start Planning Now to Comply with Identity Theft Regulation"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\"><span style=\"font-size: 10pt; font-family: Verdana;\">The Commonwealth of Massachusetts recently promulgated a new regulation, <a href=\"http:\/\/www.mass.gov\/?pageID=ocaterminal&amp;L=4&amp;L0=Home&amp;L1=Consumer&amp;L2=Privacy&amp;L3=Identity+Theft&amp;sid=Eoca&amp;b=terminalcontent&amp;f=reg201cmr17&amp;csid=Eoca\" target=\"_blank\">201 CMR 17.00<\/a>, titled <em>Standards for The Protection of Personal Information of Residents of the Commonwealth<\/em>. <span style=\"mso-spacerun: yes;\">\u00a0<\/span>The purpose of the regulation is to implement \u201c<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: Arial;\">the provisions of <a href=\"http:\/\/www.mass.gov\/legis\/laws\/mgl\/gl-93h-toc.htm\" target=\"_blank\">M.G.L. c. 93H<\/a> relative to the standards to be met by persons who own, license, store or maintain personal information about a resident of the Commonwealth of Massachusetts.\u201d Personal information is defined as:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.3in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.3in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\"><span style=\"font-size: 10pt; font-family: Verdana;\">[A] Massachusetts resident\u2019s first name and last name or first initial and last name in combination with any one or more of the following data elements that relate to such resident: (a) Social Security number; (b) driver\u2019s license number or state-issued identification card number; or (c) financial account number, or credit or debit card number, with or without any required security code, access code, personal identification number or password, that would permit access to a resident\u2019s financial account; provided, however, that \u201cPersonal information\u201d shall not include information that is lawfully obtained from publicly available information, or from federal, state or local government records lawfully made available to the general public.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0.3in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\">\u00a0<\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;\"><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: Arial;\">Since all employers should normally store \u201cpersonal information\u201d about each employee, apparently all employers who employ a resident of the Commonwealth of Massachusetts will be required to comply with the regulations. Governor Deval Patrick has also issued a related <a href=\"http:\/\/www.mass.gov\/Eoca\/docs\/idtheft\/eo504.pdf\" target=\"_blank\">Executive Order 504<\/a>\u00a0requiring certification of compliance with the order by all state contractors. There are significant procedures that must be implemented and substantial fines for non-compliance.\u00a0<a href=\"mailto:info@visionpayroll.com\" target=\"_blank\">Vision Payroll<\/a> will be communicating its compliance with the new regulations to all affected clients before 2009.
