This is the one of a continuing series that discusses FLSA exemptions. The administrative exemption allows employees who qualify as \u201cadministrative employees\u201d to be exempted from both minimum wage and overtime requirements. An earlier post discussed that to qualify for the administrative exemption, an employee\u2019 s primary duty must be \u201c<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 8.0pt;\">the performance of office or non-manual work directly related to the management or general business operations of the employer or the employer&#8217;s customers.\u201d<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 12.0pt;\"> Therefore \u201c<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 8.0pt;\">working on a manufacturing production line or selling a product in a retail or service establishment\u201d<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 12.0pt;\"> do<\/span><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 12.0pt;\">es<span style=\"color: #000000;\"> not qualify as <\/span>an <span style=\"color: #000000;\">exempt administrative function. Examples of work that does qualify include <\/span>\u201c<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 8.0pt;\">work in functional areas such as tax; finance; accounting; budgeting; auditing; insurance; quality control; purchasing; procurement; advertising; marketing; research; safety and health; personnel management; human resources; employee benefits; labor relations; public relations, government relations; computer network, internet and database administration; <\/span><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 8.0pt;\">[and] <span style=\"color: #000000;\">legal and regulatory compliance<\/span>.\u201d<\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 12.0pt;\"> <\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 8.0pt;\">The regulations specifically state that other duties not listed above may also be included in the duties of an administrative employee and that such duties may<\/span><span style=\"font-size: 10pt; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 8.0pt;\"> also<span style=\"color: #000000;\"> be performed by employees who qualify under other FLSA exemptions.<\/span><\/span><span style=\"font-size: 10pt; color: #000000; font-family: Verdana; mso-bidi-font-family: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA; mso-bidi-font-size: 12.0pt;\"> State laws may provide rules that are more beneficial to the employee and must be followed.
